01Acceptance of these terms

These Terms of Service (“Terms”) govern your access to the website at tradewindoperations.com and the free tools we provide (collectively, the “Services”), operated by Tradewind Ops LLC (“Tradewind Operations,” “we,” or “us”). By using the Services you agree to these Terms. Paid consulting engagements are governed by a separate signed agreement, which controls if it conflicts with these Terms.

02The Services

The Services include marketing information about our consultancy and free, self-serve tools, currently the Process Leak Scanner. The tools are provided for informational and illustrative purposes to help you understand where automation might help your operation.

03Estimates are not guarantees

Figures produced by our tools, including the dollar ranges the Process Leak Scanner reports, are illustrative estimates generated from assumptions and industry-typical multipliers. They are not professional, financial, engineering, or legal advice, and they are not a binding quote or a commitment by us or anyone else.

04Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Upload malware, attempt to gain unauthorized access, or disrupt or overload the Services.
• Reverse engineer, scrape, or resell the Services except as permitted by law.
• Submit confidential, personal, or third-party information you are not authorized to share.

05Intellectual property

The Services, including text, design, logos, and software, are owned by us or our licensors and protected by law. We grant you a limited, revocable, non-exclusive license to use the Services for your internal business evaluation. You keep ownership of content you submit; you grant us a limited license to process it to provide the Services.

06Fees

The website and tools are currently provided free of charge. Paid diagnostics, builds, and managed operations are quoted and contracted separately.

07Disclaimer of warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services or their output will be accurate, complete, uninterrupted, or error-free.

08Limitation of liability

To the fullest extent permitted by law, Tradewind Ops LLC and its owners and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising from your use of the free Services. Our total aggregate liability arising from the free Services will not exceed USD $100.

09Indemnification

You agree to indemnify and hold harmless Tradewind Ops LLC from claims arising out of your misuse of the Services or violation of these Terms.

10Termination

We may suspend or discontinue the Services, in whole or in part, at any time. Provisions that by their nature should survive termination will survive.

11Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute that is not subject to a separate signed agreement.

12Changes

We may update these Terms. Continued use after a change means you accept the updated Terms; the effective date appears at the top of this page.
